What is my course of legal action when the citing officer refused my right under cal. V.C. 40502B?
Because gasoline is 5 dollars a gallon more people are requesting there right under V.C. 40502B the right to have there trial held near home or employment. Surely the officer that gave me a ticket was in his 40s and I believe that he had to know the law V.C 40502b . He looked me right in the eye and refused my right to a trial at south bay court. What is my course of action. Its a seat belt ticket . Bail is 76 dollar however if I tried to fight it (roll the dice) it it would cost me about 80 dollars in gas to go east county court house. I didn't write the laws but when I start to use them to my advantage the people start to getting an attitude. Under Gov code the county seat of great city of San Diego is San Diego Gov Code 23637. It does not state Clairmont only. State law superceed county or city laws .We should at least be given the right to pay our ticket on line because of the gas prices like l los Angels county. and go to traffic school on line like los angeles county They used to say in california driving is not a right its a privilage now because of the high gas prices they say driving is not privilage its a luxury Under V.H. Code 40502A The nearest or most accessible with reference to the place where the arrest is made. Now according to google earth the place where the officer gave me the ticket was closer to south bay than to east court 1.43 miles. south bay was 5.96 miles away were east court was 7.39 miles in the opposite direction. So the officer not only violated my request which was legal and reasonable . But also violate the law himself when the ticket was not written for a court not nearest or most accessible. I was will to regretfully accept you know what and go do you know what because of the cost but now im not so sure The court judge would probly not let the officer show up because they have to pay him 300 dollars for a court appearance on his day off for a 80 dollar ticket. Even thow the officer would probly like to show up and make a quick 300 dollars Found out that county courts are picked by zip codes and not distance (Court Rules) But the trade off was V.C. 40502 (b) which I was denied
