Maryland DUI Law: Breath Tests and Legal Limits

• .07 - Prima Facie Evidence: There is a presumption that you are impaired and therefore guilty of driving under the influence. However, this presumption can be refuted either through witness testimony or cross examination of the police officer.
• .05-.06 - Neutral. No presumption or inference will be drawn from the results of your test.
• .04 - You are presumed not under the influence of alcohol.

If you are under the age of 21, it is illegal to have any alcohol in your system. Therefore, a BAC of .02 or greater is considered evidence of a crime.
